First things first

Where to start

You don’t have to decide anything about the house right away. A few early steps protect it while the family sorts things out.

  • Secure the house. Lock up, check on it regularly, and keep enough heat on in winter to protect the pipes.
  • Call the insurance company. Let them know the owner has passed and ask how the policy treats an empty house.
  • Keep the paperwork. Wills, deeds, tax notices, mortgage statements and utility bills all help later.
  • Find out how the house passes. It may go through probate, a trust, a transfer-on-death deed or joint ownership. A probate attorney can tell you which applies.

Probate, in plain terms

How probate can affect a sale

Probate is the court process for settling an estate. In Oklahoma it is filed in the district court of the county where the person lived, and the court appoints a personal representative to handle the estate’s business.

The personal representative publishes a notice to creditors, who then have a deadline to file claims. When the estate sells a house, the sale is often reported to the court and confirmed at a hearing. In some cases, when the heirs consent in writing, the court can authorize the sale without that extra step. Some estates qualify for a shorter, summary process.

This is general information, not legal advice. Your attorney can tell you how it applies to your family’s situation. The statutes are public in Title 58 of the Oklahoma Statutes.

How it works

What working with us looks like

  1. Tell us about the house. The address, its condition and where the estate stands are enough to start.
  2. We talk it through. With you, the personal representative, or the estate’s attorney, whoever you prefer. If it looks like a fit, we set a time to walk through the property.
  3. You get a straight answer. Either a written offer with the price and terms spelled out, or an honest no and the reason why.
  4. The family decides. Take the time you need. If you accept, we close through a title company on a date that fits the estate, including any court steps.

Take what matters to your family and leave the rest. No repairs, cleanup or showings on your end.

Is it a fit?

An honest answer either way

Most of the houses we buy need real work: roofs, foundations, systems, or years of updates nobody got around to.

If the house is in good shape and the family has time, listing it with an agent will often get you more, and we’ll tell you that.

Questions

Common questions from families

Can the house be sold before probate is finished?

Sometimes. Once the court appoints a personal representative, that person can usually work toward a sale, but the court often has to approve or confirm it, and the exact steps depend on the estate. Your probate attorney can tell you what your case allows. We’re used to working around those steps.

Do all of the heirs have to agree?

It depends on the will, the estate and the court. Oklahoma law lets the court authorize a sale without a separate confirmation hearing when the heirs and beneficiaries consent in writing, but every case is different. Ask your attorney before you sign anything.

Do we need to clean out the house or make repairs first?

Not for us. Take what matters to your family. We buy houses as-is, so there are no repairs, cleanup or showings on your end.

We live out of state. Can this still work?

Yes. Much of the process can be handled by phone and email, and closings run through a title company. We’ll talk through what needs to happen in person, if anything.

Is the house a good fit for you?

We buy houses that need real work. If the house is in good shape and the family has time, listing it with an agent will often bring more, and we’ll tell you that.

Is this legal advice?

No. This page is general information. Every estate is different, so please talk to an Oklahoma probate attorney about yours.
